General Terms and Conditions

1. Scope and definitions

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded via the online shop on the Wavy24.com website between us, Way2Buy GmbH, and you as our customer. The GTC apply in the version valid at the time of the order.

(2) Our offer is directed exclusively to consumers (Section 13 of the German Civil Code) with a delivery address on the German mainland. A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity.

(3) We do not accept any deviating terms and conditions of the customer. This applies even if we do not expressly object to their inclusion.

2. Conclusion of contract

(1) The presentation of our goods in the online shop does not constitute a legally binding offer to conclude a purchase contract, but a non-binding invitation to place an order (invitatio ad offerendum).

(2) You can select products from our range and collect them using the "Add to Cart" button. By clicking the "Order with payment" button, you submit a binding offer to purchase the goods in your shopping cart. You can view, change, and correct your data at any time before submitting your order.

(3) We will then send you an automatic confirmation of receipt by email, which will list your order again and which you can print using the "Print" function. This automatic confirmation of receipt merely documents that we have received your order and does not constitute acceptance of your offer.

(4) A purchase contract is only concluded when we accept your offer by sending a separate order confirmation by email or when we send the goods to you.

(5) The contract text will be stored by us in compliance with data protection regulations. You will receive all relevant order details along with the General Terms and Conditions by email. The contract language is German.

3. Prices and payment terms

(1) All prices listed on Wavy24.de are final prices in euros (€) and include VAT. Any additional shipping costs will be listed separately during the ordering process.

(2) You can use the payment methods specified during the ordering process, in particular PayPal, credit card (Visa, MasterCard), debit card and advance payment by bank transfer.

(3) For advance payment, the invoice amount must be transferred to our bank account within 7 days of receiving our order confirmation. Goods will only be dispatched after receipt of payment.

(4) If you default on a payment, we are entitled to demand default interest at the statutory rate.

4. Delivery, shipping and retention of title

(1) Delivery is made exclusively to delivery addresses within mainland Germany.

(2) Unless otherwise stated, delivery time is 2–5 business days after receipt of payment. Deviating delivery times are noted on the respective product page.

(3) If a product you have ordered is not available, we will inform you immediately and refund any payments already made.

(4) We are entitled to make partial deliveries, provided this is reasonable for you. This will not incur any additional costs for you.

(5) The risk of accidental loss and accidental deterioration of the goods shall pass to you upon delivery.

(6) The delivered goods remain our property until full payment has been made.

5. Right of withdrawal

(1) Consumers are generally entitled to a statutory right of withdrawal.

(2) Details of the right of withdrawal, in particular deadlines, exercise and consequences, as well as the model withdrawal form can be found on our separate page “Withdrawal policy” .

6. Warranty

(1) In the event of defects in the delivered goods, the statutory warranty rights apply. The warranty period is two years and begins upon receipt of the goods.

(2) Any warranties provided by the manufacturer (manufacturer's warranties) are in addition to the statutory warranty claims and do not affect them. The terms and conditions of the respective warranty can be found in the product documentation.

7. Liability

(1) We shall be liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health.

(2) In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), our liability is limited to the typical, foreseeable damage. Material contractual obligations are those whose fulfillment is essential for the proper execution of the contract and whose compliance you may regularly rely on.

(3) Furthermore, liability for slight negligence is excluded.

(4) The above limitations of liability also apply to our legal representatives and vicarious agents. They do not apply to the extent that we fraudulently concealed a defect, provided a guarantee for the quality of the goods, or for claims under the Product Liability Act.

8. Final provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another country, the application of mandatory legal provisions of that country remains unaffected by the choice of law.

(2) The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://consumer-redress.ec.europa.eu/index_de . We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(3) Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

(4) The contract language is German.
