1. Scope and definitions

(1) These General Terms and Conditions (hereinafter “Terms”) apply to all contracts concluded via the online shop on Wavy24.de between us, Way2Buy GmbH, and you as our customer. The version applicable at the time of the order shall apply.

(2) Our offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB) with a delivery address on the German mainland. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

(3) We do not accept deviating terms and conditions of the customer, even if we do not expressly object to their inclusion.

2. Conclusion of the contract

(1) The presentation of goods in our online shop does not constitute a legally binding offer to enter into a purchase agreement, but a non-binding invitation to place an order (invitatio ad offerendum).

(2) You may select products from our range and add them to the shopping cart using the “Add to cart” button. By clicking the button that confirms the order with an obligation to pay, you submit a binding offer to purchase the goods in your shopping cart. You can review, change and correct your data before submitting the order.

(3) We will then send an automatic acknowledgement of receipt by email, listing your order again. This acknowledgement merely confirms that we have received your order; it does not yet constitute acceptance of your offer.

(4) A purchase agreement is concluded only when we accept your offer by sending a separate order confirmation by email or by dispatching the goods.

(5) We store the contract text in compliance with data-protection requirements. You will receive the relevant order information together with these Terms by email. The contractual language is German.

3. Prices and payment terms

(1) All prices stated on Wavy24.de are final prices in euros (€) and include statutory VAT. Any shipping costs are shown separately during checkout.

(2) The payment methods displayed during checkout are available to you, in particular PayPal, credit card (Visa, MasterCard), debit card and advance payment by bank transfer.

(3) For advance payment, the invoice amount must be transferred to our bank account within seven days of receipt of our order confirmation. The goods will be dispatched only after payment has been received.

(4) If you are in default of payment, we are entitled to charge statutory default interest.

4. Delivery, shipping and retention of title

(1) Delivery is made exclusively to delivery addresses on the German mainland.

(2) Unless otherwise stated, delivery takes two to five working days after receipt of payment. Any different delivery times are stated on the relevant product page.

(3) If a product you ordered is unavailable, we will inform you without delay and refund any payments already made.

(4) We may make partial deliveries insofar as this is reasonable for you. You will not incur any additional costs as a result.

(5) The risk of accidental loss and accidental deterioration of the goods passes to you when the goods are handed over.

(6) The goods remain our property until payment has been made in full.

5. Right of withdrawal

(1) Consumers generally have a statutory right of withdrawal.

(2) Details regarding the period, exercise and consequences of withdrawal, as well as the model withdrawal form, are set out on our separate “Withdrawal instructions” page.

6. Statutory warranty

(1) The statutory warranty rights apply in the event of defects in the goods supplied. The warranty period is two years and begins when you receive the goods.

(2) Any manufacturer’s guarantees apply in addition to the statutory warranty rights and do not affect them. The applicable guarantee conditions can be found in the product documentation.

7. Liability

(1) We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, limb or health.

(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment you may regularly rely.

(3) Liability for other cases of slight negligence is excluded.

(4) These limitations of liability also apply in favour of our legal representatives and vicarious agents. They do not apply where we fraudulently concealed a defect, provided a guarantee regarding the quality of the goods or where claims arise under the German Product Liability Act.

8. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another country, this choice of law does not affect the application of mandatory legal provisions of that country.

(2) The European Commission provides an online dispute-resolution platform at https://consumer-redress.ec.europa.eu/index_de. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.

(4) The contractual language is German.
